After the episode, Winters said he turned to what had become a trusted source of advice: ChatGPT. \u201cTake it easy,\u201d the chatbot allegedly suggested.\u00a0<\/p>\n<p>\n\tIt was ChatGPT\u2019s \u201cextremely dangerous\u201d medical advice along these lines that led Winter to delay seeking professional care for what was later determined to be a pulmonary embolism, according to a lawsuit Winters filed against OpenAI and its CEO Sam Altman, the <em>New York Times<\/em> reported.\u00a0<\/p>\n<p>\n\tThe lawsuit, which was filed Wednesday in California, accuses the company of negligence, as well as practicing medicine \u201cunauthorized\u201d because ChatGPT allegedly attempted to diagnose Winters and cooked up treatment plans for him.\u00a0<\/p>\n<div>\n<div>\n<div>\n<\/div>\n<\/div>\n<\/div>\n<p>Read more <a href=\"https:\/\/businessmovingservicess.com\/?p=431\">Nolan Wells Preliminary Independent Autopsy Says Cause of Death Is Still \u2018Undetermined\u2019<\/a><\/p>\n<p>\n\tUp until Winters sought care at a hospital in June 2025, Winters claimed the chatbot fed him lines like his symptoms were \u201cnot something dangerous\u201d and that \u201cGod did not design your body to endlessly fail,\u201d according to the <em>Times<\/em>. When Winters voiced concern about people thinking he was \u201ccrazy for not going to the hospital,\u201d the lawsuit alleged the chatbot reassured Winters that \u201cmost people (including well-meaning church members) simply don\u2019t understand\u201d the help it was purportedly providing him.\u00a0<\/p>\n<p>\n\tIn a statement to <em>Rolling Stone,<\/em> company spokesperson Drew Pusateri said in part that \u201cChatGPT is not a doctor and should never be used as a substitute for medical care, diagnosis, or treatment.\u201d However, Pusateri countered, \u201ctreating chatbots as the whole story behind people\u2019s medical decisions or outcomes oversimplifies a much bigger challenge, and risks getting in the way of people accessing powerful new tools that can aid them in their health journey.\u201d\u00a0<\/p>\n<p>\n<em>Rolling Stone <\/em>has reached out to Winters\u2019 representatives for further comment.\u00a0<\/p>\n<div>\n<div>\n<div>\n<\/div>\n<\/div>\n<\/div>\n<p>\n\tWinters\u2019 case is among the growing number of lawsuits against OpenAI. Last year, a family sued the company for wrongful death and the unauthorized practice of medicine in wake of their 16-year-old son dying by suicide after ChatGPT allegedly \u201ccoached\u201d him into the act.
